Details: Join us for a CLE presented by Melanie D’Isidoro.  Guardianships and conservatorships are among the most important protections available to vulnerable Montanans, yet many practitioners may be unsure where to begin. This CLE will offer attorneys a practical introduction to guardianship and conservatorship, including what each involves, how they differ, who may need one, and how they interact with an existing power of attorney. The presenter will also explain the difference between temporary and permanent appointments, including what can be obtained on an emergency basis and what follows a final hearing.

The presenter will walk through the process of filing for and obtaining a guardianship or conservatorship. This includes the petition, affidavits, physician’s report, visitor’s report, and supporting evidence; the roles of the parties, their counsel, healthcare providers, and the visitor; and what must be proven at the hearing, who needs to attend, and the testimony required. The program will close with a discussion of common ethical pitfalls in this area of practice. Attendees will leave with a clear roadmap for handling a guardianship or conservatorship from start to finish. This CLE is well suited for attorneys who are new to this area or who may encounter it in family law, elder law, or general practice, as well as those simply looking to build foundational knowledge.
